Cyamate Worksite Check-In & Safety Verification

These Terms of Service ("Terms") govern your use of the worksite check-in and safety verification service (the "Service") operated by Cyamate, Inc. ("Cyamate," "we," "us," or "our"). By checking in through the Service or using this website, you agree to these Terms.
1. The Service
The Service lets workers check in at participating construction worksites by scanning a posted QR code, complete a safety orientation and spoken safety assessment when required, and receive a sticker number confirming completion. The Service is provided to the general contractor or site operator running the worksite (the "Worksite Operator"), who determines how it is used at their site.
2. Your responsibilities
When you check in, you agree to provide accurate information: your real name, the company you actually work for, and a phone number you control. You agree to check in only as yourself and not on behalf of another person, and to complete safety assessments yourself. Misrepresenting your identity or the company you work for may result in your records being flagged or removed by the Worksite Operator.
3. Safety assessments and site access
The spoken safety assessment confirms your understanding of the worksite's safety orientation. If an answer shows a misunderstanding, it is addressed during the conversation. If you do not complete an assessment successfully, you may take it again.
Completing an assessment and receiving a sticker number confirms that you went through the worksite's orientation process. It is not a professional certification, license, or guarantee of competency. All decisions about site access, work assignments, and safety compliance are made by the Worksite Operator and your employer, not by Cyamate. The Service supplements, and does not replace, your employer's and the Worksite Operator's safety training and legal obligations.
4. Text messaging program
Cyamate offers an optional text messaging program that delivers your sticker number by text after you complete a safety assessment.
By opting in during check-in, you agree to receive transactional text messages from Cyamate at the mobile number you provided. Message frequency is about 1 message per safety assessment. Message and data rates may apply. Reply STOP to cancel or HELP for help. For additional assistance, contact stephen@cyamate.com or +1 (839) 293-2058. Wireless carriers are not liable for delayed or undelivered messages.
Consent to text messages is not a condition of checking in or using the Service. If you do not opt in, you can get your sticker number by scanning the worksite QR code again. Participation in this program is subject to these Terms and our Privacy Policy.
5. Records
Check-in records, attendance history, sticker numbers, and assessment transcripts are maintained as part of the worksite's safety records and are made available to the Worksite Operator. How we handle personal information is described in our Privacy Policy.
6. Acceptable use
You agree not to misuse the Service, including by attempting to access records that are not yours, interfering with the operation of the Service, scanning or using QR codes for worksites where you are not working, or using the Service for any unlawful purpose.
7. Intellectual property
The Service, including its software, design, and content (other than information you provide), is owned by Cyamate and protected by law. These Terms do not grant you any rights in the Service beyond the limited right to use it as intended.
8. Disclaimers and limitation of liability
The Service is provided "as is" and "as available." To the fullest extent permitted by law, Cyamate disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose, and does not warrant that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, Cyamate's total liability arising out of or relating to the Service will not exceed the amounts (if any) you paid to use the Service, and Cyamate will not be liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles. Any dispute arising out of these Terms or the Service will be brought in the state or federal courts located in North Carolina.
10. Changes to these Terms
We may update these Terms from time to time. The updated version will be indicated by the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
